These Terms of Use ("Terms") are a binding agreement between you ("you", "your", the "Member") and IW Services and Matrimonial Private Limited (CIN U56210DL2023PTC414515), which owns and operates Evara Matrimony ("Evara", "we", "us", "our"). Evara Matrimony was formerly known as Imperial Weddings; it is the same company, renamed in 2024, serving families since 2009.
By accessing or using the Evara website and services (the "Platform"), you agree to these Terms and to our Privacy Policy, which is incorporated here by reference. If you do not agree, please do not use the Platform.
These Terms are published in accordance with Rule 3(1) of the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, and the Information Technology Act, 2000.
1. About Evara and the nature of our service
Evara is a matrimony platform. We help individuals and their families find a marriage match, through self-serve membership and, in our assisted tiers, through matchmaking support provided by the Evara team. Evara is intended solely for lawful matrimony between persons legally competent to marry. The Platform is not a dating service and must not be used for casual dating or for any commercial purpose. Evara is an intermediary as defined under Section 2(w) of the Information Technology Act, 2000. We facilitate introductions; we do not arrange, solemnise, or guarantee any marriage, engagement, or match. Profiles and information are provided by Members. An introduction made through Evara is not a recommendation or an assurance by Evara about any Member.
2. Eligibility
To create an account or use the Platform, you must be at least 18 years of age and legally competent to contract. To use Evara for matrimony, you must be of legal marriageable age under the laws applicable to you, unmarried or otherwise legally free to marry, and not restrained by any law, order, or decree from entering into marriage. By using the Platform you represent and warrant that you meet these requirements and that all information you provide is true, current, and accurate. Membership is void where prohibited by law.
3. Accounts and membership
Access to browse-and-connect features requires registration and membership. We offer membership plans and assisted services at different tiers. The features available to you depend on your membership status and tier. A free account has limited, receive-only access; full access requires an active paid membership. Where a trial is offered, it forms the first part of a paid membership for which you have set up payment, and not a separate or standalone free entitlement.
4. Fees, payments, and GST
All fees are displayed on the Platform and, where applicable, are recurring. All prices are inclusive of 18% GST. Payments are processed through our payment partner; you authorise the applicable charge when you subscribe or purchase. The amount payable is the amount stated by Evara at checkout. For the Reserve service, a registration fee is payable at the outset and a separate success fee becomes payable on a confirmed Roka arising from an introduction made by Evara, on the terms presented to you at registration. Assisted services, including Select, Reserve, and Luxe, are delivered by the Evara team.
5. Refunds
All payments to Evara Matrimony are final and non-refundable. Membership and service fees, once paid, are not refundable in whole or in part, including for unused periods, voluntary cancellation, or if you do not find a match. The only exceptions are duplicate charges, failed transactions where money was deducted but access was not granted, or amounts charged in error, which we will verify and refund to the original payment method within 7 to 10 working days of confirmation. To report such a charge, email connect@evaramatrimony.com with your transaction details. This policy is in addition to your rights under applicable law.
6. Account security
You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at connect@evaramatrimony.com of any unauthorised access or use of your account or any other breach of security, and log out at the end of each session.
7. Your content and conduct
You must use your real identity and provide truthful information. You retain ownership of the content you upload ("Your Content"). By uploading Your Content, you grant Evara a non-exclusive, royalty-free licence to host, display, and use it for the purpose of providing the service, including displaying your profile to other Members. You are responsible for Your Content, and you confirm you have the right to share it. You must not upload or share content that is unlawful, obscene, sexually explicit, defamatory, abusive, harassing, threatening, discriminatory, or that promotes hatred; that infringes any third party's rights, including intellectual property and privacy rights; that contains commercial solicitation, spam, or links unrelated to matrimony; or that contains any virus or malicious code. We may remove, edit, or restrict access to any content at any time, and we have no obligation to review content. Other Members' content belongs to them. You may use another Member's information only to the extent necessary for the matrimony purpose of the Platform. You must not use other Members' data for any commercial purpose, to spam, to harass, or to threaten. We may suspend or terminate your account if you misuse other Members' information.
8. Verification
Evara may require identity, photograph, and face verification before an account can appear in browse or interact with others, and may use third-party providers for this. You consent to such verification. Verification helps reduce misuse but is not a guarantee of any Member's identity, intentions, or information, and you should exercise your own judgment in all interactions.
9. Personal and non-commercial use
The Platform is for the personal, non-commercial use of individual Members seeking matrimony. Organisations, companies, and businesses may not register or use the Platform. Unauthorised or unlawful use, including unauthorised framing of or linking to the Platform, may be investigated and may result in legal action.
10. Suspension and termination
You may cancel your membership or delete your account at any time from your account settings. If you do, you will not be entitled to a refund of any unutilised fees, except as set out in Clause 5. We may suspend or terminate your access for any breach of these Terms, misrepresentation, misuse of the Platform, or conduct we consider harmful to other Members or to Evara, by notice to the email address associated with your account. Where we terminate for breach, you will not be entitled to any refund of fees paid. Clauses that by their nature should survive termination, including those on content, disclaimers, limitation of liability, indemnity, and dispute resolution, will survive.
11. Intellectual property
All text, graphics, interfaces, trademarks, logos, and other material provided by Evara ("Our Content") are owned, controlled, or licensed by us and are protected by law. We grant you a limited, non-transferable, non-sublicensable licence to use Our Content only as enabled by the Platform's functionality and for lawful purposes. You must not copy, sell, modify, or create derivative works from Our Content, or use our name in metatags, keywords, or hidden text. All rights not expressly granted are reserved.
12. Copyright complaints
If you believe content on the Platform infringes your copyright, write to us at connect@evaramatrimony.com with: identification of the copyrighted work; identification and location of the allegedly infringing material; your contact details; a statement of your good-faith belief that the use is not authorised; and a statement, made by you, that the information in your notice is accurate and that you are the owner or authorised to act for the owner.
13. Third-party services
We rely on third parties for services such as payment processing, hosting, communications, and verification. Where a third-party service is involved, your use of it may be subject to its own terms. Evara is not responsible for third-party services or for any vendor, service, or offering that is not provided by Evara.
14. Disclaimers
The Platform and services are provided on an "as is" and "as available" basis. Evara does not guarantee, expressly or impliedly, any match, marriage, compatibility, or specific result from your use of the Platform. The exchange of a profile through Evara is not a matrimonial offer or recommendation by Evara. Evara is not responsible for the accuracy of Member content, for the conduct of any Member whether online or offline, or for any loss or harm arising from any interaction or relationship formed through the Platform. For your safety, do not share financial information with, or send money to, other Members.
15. Limitation of liability
To the maximum extent permitted by law, Evara and its directors, officers, employees, agents, and partners will not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for any loss of profits, revenue, data, or goodwill, arising out of or relating to these Terms or your use of or inability to use the Platform. To the maximum extent permitted by law, Evara's total aggregate liability for all claims arising out of or relating to these Terms or the Platform will not exceed the total fees you paid to Evara in the twelve months immediately preceding the event giving rise to the claim.
16. Indemnity
You agree to indemnify and hold harmless Evara, its affiliates, and their officers, agents, partners, and employees from any claim, loss, liability, or demand, including reasonable legal fees, arising from your use of the Platform in breach of these Terms, from Your Content, or from your breach of any representation or warranty in these Terms.
17. Dispute resolution
Any dispute arising out of or relating to these terms or your use of Evara Matrimony will first be addressed through our Grievance Officer. If it cannot be resolved within 30 days, it will be referred to and finally settled by arbitration before a sole arbitrator appointed by Evara, conducted under the Arbitration and Conciliation Act, 1996. The seat and venue of arbitration will be Delhi, and the proceedings will be in English. The courts at Delhi will have exclusive jurisdiction over any matter requiring judicial supervision.
18. Grievance Officer
In accordance with the Digital Personal Data Protection Act, 2023, you may raise any concern about your personal data or our services with our Grievance Officer. We acknowledge every grievance within 48 hours and resolve it within 7 working days.
19. Governing law
These Terms are governed by the laws of India.
20. Changes to these Terms
We may update these Terms from time to time. We will post the updated Terms on the Platform and, where the change is material, take reasonable steps to notify you. Your continued use of the Platform after an update means you accept the revised Terms.
