Marriage, OCI, and documents

Families across the US often ask what a cross-border marriage means legally, and it is worth understanding before the wedding. Registering the marriage is your proof of it for visas, spousal sponsorship, and legal protection. If the wedding takes place in India, the certificate carries weight in the United States because India has been part of the Hague Apostille Convention since 2005, so an Indian marriage certificate can be apostilled for legal use here. A foreign-national spouse can, in time, apply for Overseas Citizenship of India, the status introduced under the Citizenship (Amendment) Act of 2005, once the marriage is registered and has subsisted for at least two years.

The Ministry of External Affairs publishes guidance for Indians marrying abroad and offers support for people, women in particular, who face distress in a cross-border marriage. Every US state and the federal system run their own processes, and we are not lawyers or immigration advisers, so we point families to official government sources for the formalities.
